Membership Agreement

It is recommended that the User Agreement, which includes the general terms of use of the site, related general rules, and legal responsibilities, be read before using missdiamond.com.tr.

If the specified conditions are not suitable for you, please do not use the missdiamond.com.tr site. By using the site and filling out the form with your personal information, you are deemed to have accepted the terms written on these pages.

Miss Diamond reserves the right to update the content of this legal notice page at any time and advises its users to visit the legal notice page each time they enter the site.

1. Usage and Security Rules

The Usage and Security Rules are open to all members of missdiamond.com.tr. The services provided on the site are free of charge unless otherwise specified.

In the following written cases, the site management may prevent the member from using the site and reserves its legal rights against the person or persons involved in the following attempts.

1.a. Recording incorrect, irregular, incomplete, and misleading information, statements that do not comply with general moral rules, and information that is contrary to the laws of the Republic of Turkey.

1.b. Partial or complete copying of the site content without permission.

1.c. The User is directly responsible for any damages arising from the sharing of information such as username and password, given to users or determined by them, with third parties or organizations (use of this information by persons other than the user). Likewise, the user cannot use personal information belonging to others on the internet, such as IP addresses, email addresses, or usernames, nor can they access or use the private information of other users without permission. The user is deemed to have accepted any legal and criminal liability that may arise from such use.

1.d. The use of software, engaging in activities, or attempting to engage in activities that will threaten the security of the site, prevent the operation of the site and its software, and the acquisition, deletion, or modification of information.

2. Content Usage

2.a. The visual and written content presented on missdiamond.com.tr is for personal use. All materials ("Materials") within the content of missdiamond.com.tr, including all domain names, logos, icons, demonstrative, written, electronic, graphic, or machine-readable technical data, the applied sales system, business method, and business model, and the intellectual and industrial property rights related to them, are owned or licensed by and are under legal protection. Unless otherwise specified, it cannot be used for commercial or personal purposes without permission or citation. It is forbidden to publish any element on this site in another medium or website or to link to it without the permission of Miss Diamond.

2.b. The rights to the software used in the design of these pages and the creation of the database belong to Miss Diamond. Copying or using this software is strictly prohibited.

2.c. The rights to all criticisms sent to missdiamond.com.tr belong to Miss Diamond and can be used for marketing purposes by Miss Diamond if desired.

3. Responsibilities

3.a. The information of users visiting missdiamond.com.tr (duration of visit, time, pages viewed) is tracked to better serve them. This information, while adhering to privacy conditions, is shared with the companies we cooperate with on advertising, etc., to expand and improve the content. The aim here is to enhance the experience offered to users and to improve missdiamond.com.tr.

3.b. The user of missdiamond.com.tr can start using the missdiamond.com.tr site by entering their email address and password, provided they comply with the conditions specified in this agreement after filling out the required sections for registration and confirming their email address.

3.c. While using the missdiamond.com.tr site and its services, the user agrees to comply with the Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Decree-Laws on the Protection of Trademarks and Patents, the Code of Obligations, other relevant legislation, and any announcements and notifications that missdiamond.com.tr may publish regarding its services. All legal, criminal, and financial liability that may arise from use contrary to these notices and laws belongs to the user.

3.d. If it is determined that the User does not comply with the obligations specified in this agreement or the general rules reported on the missdiamond.com.tr site, their access to missdiamond.com.tr may be blocked by Miss Diamond for a definite or indefinite period, and/or their account may be closed.

3.e. The user cannot engage in actions that prevent or hinder other users and visitors from using missdiamond.com.tr, nor can they force/lock servers or databases by installing automatic programs. They cannot attempt fraud. If found, they accept that their membership will be terminated and they will assume all legal and criminal liability that may arise from the situation.

3.f. It is the responsibility of individuals to back up messages exchanged with missdiamond.com.tr, and this is recommended by Miss Diamond. Miss Diamond cannot be held responsible for the loss, deletion, or damage of messages due to the failure to back them up.

3.g. The user cannot delete or remove any copyright, trademark, or any other notices under the Law on Intellectual and Artistic Works from any material copied or printed from missdiamond.com.tr.

3.h. Membership cancellation and account deletion can be done by the user via missdiamond.com.tr. The user whose membership is terminated will have their access to the site revoked. The person who cancels their membership accepts that this action is irreversible.

3.i. The decision to delete or not to delete any record belonging to the user account terminated by missdiamond.com.tr or the user themselves rests with Miss Diamond. The user cannot claim any rights or compensation for the deleted records.

3.j. The relationships between site users and third parties are their own responsibility.

3.k. missdiamond.com.tr may contain links or references to other websites that are not under its control. Miss Diamond is not responsible for the content of these sites or any other links they contain.

3.l. Miss Diamond reserves the right to use all information associated with your user account for its own marketing activities, subject to the terms of use, privacy principles, and applicable legal regulations.

3.m. Different rules and obligations specific to certain sections of the site may be specified. Persons and organizations using these sections are deemed to have accepted these rules in advance.

3.n. To read about the measures we take to protect our users' personal information and privacy and our general policy on this matter, please read the "Privacy Policy" section.

The user agrees that from the moment they start using the service, they will be deemed to have accepted all the provisions of this participation agreement and that the agreement will be binding on them. The user agrees to compensate for any damages Miss Diamond may suffer due to their actions contrary to the obligations undertaken in this agreement. Miss Diamond has the right to recourse against the User for any compensation and/or administrative/judicial fines it may have to pay to public institutions and/or third parties due to the user's behavior contrary to the agreement.

4. Rights and Obligations of Miss Diamond

4.a. Miss Diamond accepts and undertakes that the user will benefit from the services subject to the contract, except for technical failures, and that the information shared by the user, other than personal information, will not be shared with any third party or organization except for legal obligations. If it is determined that the user has engaged in any electronic sabotage, attempts to interfere with earnings, and/or attacks that would prevent the operation of the missdiamond.com.tr site, or if a criminal complaint or official investigation request is received from the authorities against the member, missdiamond.com.tr has the right to investigate and disclose the identity information of the relevant member.

4.b. Miss Diamond may make unilateral changes to this agreement without any notice to ensure the continuity of the services it undertakes. Miss Diamond always has the right, without giving any reason, to permanently or temporarily stop the service it provides, to change the content of the service, or to cancel it. The user accepts this right. In case of any changes, Miss Diamond will publish the updated terms of use on its site under the same link with a new date update and will notify its users by email if it deems necessary. The renewed current terms of use will be valid from the moment they are published on missdiamond.com.tr, and the use of the missdiamond.com.tr site or services will be subject to the renewed terms of use from that moment on.

The membership of a member who has sent material contrary to the provisions of this agreement to the missdiamond.com.tr site may be unilaterally terminated by Miss Diamond without any notification.

4.c. missdiamond.com.tr has the right to use any email, phone, and other information provided by users during membership for campaigns, advertisements, and promotional activities.

5. Enforcement of the Agreement

The user is deemed to have committed to comply with the missdiamond.com.tr agreement from the moment they fill out and approve the registration form or receive any service or place an order using this system. The agreement will automatically become void without any warning upon the termination of membership or the occurrence of any of the termination conditions listed in this agreement.

6. Competent Court and Dispute Resolution

Istanbul Courts and Enforcement Offices are authorized for the resolution of disputes that may arise from the application of this agreement.

7. Notification Addresses

7.a. The missdiamond.com.tr site does not request postal addresses from its users in advance. However, the email address provided by the user to missdiamond.com.tr is considered the legal address for any notification to be made regarding this agreement.

7.b. The parties agree that unless they notify the other party in writing of any changes to their existing emails within 3 (three) days, requests made to the old emails will be considered valid and deemed to have been made to them.

7.c. It will be accepted that any notification made by missdiamond.com.tr using the user's registered email address will reach the user 1 (one) day after the email is sent by missdiamond.com.tr. The user declares, accepts, and undertakes that they have read, understood, and accepted all the articles in this participation agreement and confirm the accuracy of the information they have provided about themselves.
