Membership Agreement
Before using missdiamond.com.tr, it is highly recommended to read this User Agreement, which contains the general terms of use of the site, related rules, and legal liabilities.
If the specified terms are not suitable for you, please do not use the missdiamond.com.tr website. By using the site and filling out the form that includes your personal details, you are deemed to have accepted the conditions written on these pages.
Miss Diamond reserves the right to update the content of this legal disclaimer page at any time and advises its users to visit the legal disclaimer page upon every visit to the site.
1. Rules of Use and Security
The Rules of Use and Security are open to all members of missdiamond.com.tr. Unless stated otherwise, the services provided on the site are free of charge.
In the following cases, the site administration may block the member's use of the site and reserves its legal rights against the person or persons involved in the following actions:
1.a. Recording information on the site that contains incorrect, irregular, incomplete, or misleading information, expressions that do not comply with general ethics, or data that conflicts with the laws of the Republic of Türkiye;
1.b. Copying site content partially or fully without authorization;
1.c. The User is directly responsible for any damages resulting from sharing user names, passwords, and access rights given to them or determined by themselves with third parties or organizations (as well as the use of this information by individuals other than the user). Likewise, the user cannot use personal details belonging to someone else such as IP addresses, email addresses, or usernames in the internet environment, nor can they access or use the private information of other users without permission. The user is deemed to have accepted all legal and criminal liabilities that may arise from such use;
1.d. Using software, engaging in activities, attempting to engage in activities, or acquiring, deleting, or modifying data that threatens the security of the site or prevents the smooth operation of the site and the software utilized.
2. Use of Content
2.a. The visual and written content provided on missdiamond.com.tr is for personal use. Miss Diamond is the owner or licensee of all materials ("Materials") presented on missdiamond.com.tr, including but not limited to domain names, logos, icons, demonstrative, written, electronic, graphic, or machine-readable technical data, the sales system applied, business methods, and business models, and these are under legal protection. Unless stated otherwise, they cannot be used for commercial or personal purposes without authorization or without citing the source. It is prohibited to publish any element of this site in another media or website, or to provide a link to it without the explicit permission of Miss Diamond.
2.b. The software used in designing these pages and creating the database belongs to Miss Diamond. Copying or using the aforementioned software is strictly prohibited.
2.c. The rights to all critiques and reviews submitted to missdiamond.com.tr belong to Miss Diamond, and they may be used by Miss Diamond for marketing purposes if desired.
3. Responsibilities
3.a. Data regarding users visiting missdiamond.com.tr (duration of visit, time, pages viewed) is tracked in order to provide them with a better service. This information is shared with companies we cooperate with for advertisements and similar issues, in adherence to privacy conditions, with the aim of expanding and optimizing content. The goal here is to improve the experience the site offers to its users and to develop missdiamond.com.tr.
3.b. After completing the fields required for registration and verifying their email address, the missdiamond.com.tr user can start using the missdiamond.com.tr website by entering their email address and password, provided they comply with the conditions specified in this agreement.
3.c. While using the missdiamond.com.tr site and its services, the user agrees to comply with the Turkish Penal Code, the Turkish Commercial Code, the Law on Intellectual and Artistic Works, Decree-Laws and Legal Regulations on the Protection of Trademark and Patent Rights, the Law of Obligations, other relevant legislation provisions, and all announcements and notices to be published by missdiamond.com.tr regarding its services. Any legal, criminal, and financial liability that may arise due to usage contrary to these notices and laws belongs exclusively to the user.
3.d. In the event that the user is found to have breached the obligations specified in this agreement or the general rules announced on the missdiamond.com.tr site, the user's access to missdiamond.com.tr may be suspended temporarily or indefinitely by Miss Diamond, and/or their account may be closed.
3.e. The user cannot engage in actions that prevent or make it difficult for other users and visitors to use missdiamond.com.tr, nor can they overload/lock the servers or databases by running automated programs. They cannot attempt fraudulent activities. They accept that if they do so, their membership will be terminated and they will assume all legal and criminal responsibility arising from the situation.
3.f. Backing up messages exchanged on missdiamond.com.tr is the responsibility of the individuals and is recommended by Miss Diamond. Miss Diamond cannot be held responsible for messages being lost, deleted, or damaged due to failure to take backups.
3.g. The user cannot delete or remove any notes within the scope of Copyright, Trademark, or the Law on Intellectual and Artistic Works from any material copied or printed out from missdiamond.com.tr.
3.h. Membership cancellation and account deletion can be performed by the user via missdiamond.com.tr. The access authorization of a user who terminates their membership will be revoked. The person who cancels their membership accepts that this process is irreversible.
3.i. The decision to delete or retain any records belonging to a user account terminated by missdiamond.com.tr or by the user themselves rests with Miss Diamond. The user cannot claim any rights or compensation regarding deleted records.
3.j. Relationships between site users or between users and third parties are under the sole responsibility of the individuals themselves.
3.k. missdiamond.com.tr may contain links or references to other websites that are not under its control. Miss Diamond is not responsible for the content of these sites or any other links they contain.
3.l. Miss Diamond reserves the right to use all information linked to your user account for its own marketing activities, provided that it adheres to the terms of use, privacy principles, and applicable legal regulations.
3.m. Different rules and obligations specific to a particular section may be stated in certain parts of the site. Persons and organizations using these sections are deemed to have accepted these rules in advance.
3.n. To read our general policy and the measures we take to protect our users' personal details and privacy, please read the "Privacy Agreement" section.
The user agrees that from the moment they start benefiting from the service, they will be deemed to have accepted all provisions of this participation agreement and that the agreement will remain effective for them. The user agrees to compensate Miss Diamond in full for any damages it may incur due to actions contrary to the obligations undertaken with this agreement. Miss Diamond has the right of recourse to the User for any compensation and/or administrative/judicial fines that it may have to pay to public institutions and/or third parties due to the user's behaviors contrary to the agreement.
4. Rights and Obligations of Miss Diamond
4.a. Miss Diamond accepts and undertakes that the user will be provided with the services subject to the agreement, except for technical failures, and that information other than the personal details opened to sharing by the user will not be shared with third parties or organizations under any circumstances, except for legal requirements. In the event that it is determined that the user has caused any electronic sabotage, interference with earnings, and/or attack that hinders the operation of the missdiamond.com.tr site, or if a criminal complaint or official investigation request is received from official authorities regarding the member, missdiamond.com.tr has the right to investigate and disclose the identity details of the relevant member.
4.b. In order to ensure the continuity of the services it undertakes, Miss Diamond may make unilateral modifications to this agreement without any prior notice. Miss Diamond always reserves the right to continuously or temporarily stop the service it provides unilaterally without showing any justification, change the content of the service, or cancel it. The user accepts this right. In case of any changes, Miss Diamond will publish the updated terms of use on its site under the same link with a new date update, and if deemed necessary, will notify its users via email. The renewed up-to-date terms of use will become effective from the moment they are published on missdiamond.com.tr, and the use of the missdiamond.com.tr site or its services from that point onward will be subject to the renewed terms of use.
The membership of a member who has sent materials contrary to the provisions of this agreement to the missdiamond.com.tr site may be terminated unilaterally by Miss Diamond without any prior notice.
4.c. missdiamond.com.tr has the right to use all kinds of information such as email, phone numbers, etc. provided by users during membership for campaigns, advertisements, and promotional activities.
5. Enforcement of the Agreement
The user is deemed to have undertaken to comply with the missdiamond.com.tr agreement from the moment they fill out and approve the registration form, receive any service, or place an order using this system. The agreement will automatically become void without the need for any warning upon the termination of the membership or upon the occurrence of any of the termination conditions listed in this agreement.
6. Authorized Court and Resolution of Disputes
The Courts and Enforcement Offices of Istanbul are authorized to resolve any disputes that may arise from the implementation of this agreement.
7. Notification Addresses
7.a. The missdiamond.com.tr site does not ask its users for their postal addresses in advance. However, the email address provided by the user to missdiamond.com.tr is accepted as the legal address where any notification to be made regarding this agreement will be requested.
7.b. Unless the parties notify the other party in writing of modifications to their current emails within 3 (three) days, they agree that requests made to old emails will be valid and deemed to have been made to themselves.
7.c. Likewise, any notification to be made by missdiamond.com.tr using the user's registered email address will be deemed to have reached the user 1 (one) day after the email is sent by missdiamond.com.tr. The user declares, accepts, and undertakes that they have read, understood, and accepted all the articles contained in this participation agreement and that they confirm the accuracy of the information they have given about themselves.
