Membership Agreement

The general terms of use of the site, its general rules, and legal responsibilities are included in the User Agreement below. It is recommended that the User Agreement be read before using missdiamond.com.tr.

If the specified terms are not suitable for you, please do not use the missdiamond.com.tr site. By using the site and filling out the form that will contain your personal information, you are deemed to have accepted the terms written on these pages.

Miss Diamond reserves the right to update the content of this legal notice page at any time and advises its users to visit the legal notice page with every entry to the site.

1. Usage and Security Rules

The Usage and Security Rules are open to all members of missdiamond.com.tr. The services provided on the site are free of charge unless otherwise specified.

In the cases written below, the site management may prevent the member from using the site and reserves its legal rights against the person or persons involved in the following attempts.

1.a. Recording false, irregular, incomplete, and misleading information, expressions that are not in accordance with general moral rules, and information that is contrary to the laws of the Republic of Turkey.

1.b. Copying the site content partially or in full without permission.

1.c. The User is directly responsible for any damage arising from the sharing of information such as usernames and passwords, or usage rights given to users or determined by them, with third parties or organizations (from the use of this information by persons other than the user). In the same way, the user cannot use a personal information such as another person's IP address, e-mail address, or username in the internet environment, nor can they access or use the private information of other users without permission. The user is deemed to have accepted all kinds of legal and criminal liability that may arise from such use.

1.d. The use of software, or attempts to use software, that threatens the security of the site, prevents the operation of the site and the software used, and the acquisition, deletion, or modification of information.

2. Content Usage

2.a. The visual and written content offered on missdiamond.com.tr is for personal use. missdiamond.com.tr is the owner or license holder of all domain names, logos, icons, demonstrative, written, electronic, graphic, or machine-readable technical data, the applied sales system, business method, and business model, including all materials ("Materials") and the intellectual and industrial property rights related to them, and they are under legal protection. Unless otherwise specified, they cannot be used for commercial or personal purposes without permission or without showing the source. It is forbidden to publish any element on this site on another medium or website or to link to it without the permission of Miss Diamond.

2.b. The right to the software used in the design and creation of the database of these pages belongs to Miss Diamond. Copying or using the said software is strictly forbidden.

2.c. The right to all criticisms sent to missdiamond.com.tr belongs to Miss Diamond and can be used by Miss Diamond for marketing purposes if requested.

3. Responsibilities

3.a. The information of users visiting missdiamond.com.tr (duration of visit, time, pages viewed) is monitored to better serve them. This information, subject to the privacy terms, is shared with companies we cooperate with on advertising, etc., to expand and improve the content. The aim here is to improve the experience the site offers its users and to develop missdiamond.com.tr.

3.b. A missdiamond.com.tr user can start using the missdiamond.com.tr site by entering their e-mail address and password after filling out the required sections for registration and confirming their e-mail address, provided that they comply with the terms specified in this agreement.

3.c. The user agrees to comply with the Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Decree-Laws and Legal Regulations on the Protection of Trademark and Patent Rights, the Law of Obligations, other relevant legal provisions, and all kinds of announcements and notifications to be published by missdiamond.com.tr regarding its services. All kinds of legal, criminal, and financial responsibilities that may arise due to the use contrary to these notifications and laws belong to the user.

3.d. In the event that the user fails to comply with the obligations specified in this agreement or the general rules notified on the missdiamond.com.tr site, the user's access to missdiamond.com.tr may be temporarily or permanently blocked and/or their account may be closed by Miss Diamond.

3.e. The user cannot engage in activities that prevent or make it difficult for other users and visitors to use missdiamond.com.tr, nor can they load automatic programs and force/lock the servers or databases. They cannot attempt to cheat. In the event of such an attempt, they accept that their membership will be terminated and all kinds of legal and criminal liability that may arise from the situation.

3.f. It is the responsibility of individuals to back up their messages with missdiamond.com.tr, and it is recommended by Miss Diamond. Miss Diamond cannot be held responsible for the loss, deletion, or damage of messages due to the lack of backups.

3.g. The user cannot delete or remove any notes related to Copyright, Trademark, and all kinds of Intellectual and Artistic Works Law from any material copied or printed from missdiamond.com.tr.

3.h. Membership cancellation and account deletion can be done by the user via missdiamond.com.tr. The site entry authority of the user who ends their membership will be canceled. The person who cancels their membership accepts that this transaction is irreversible.

3.i. The decision to delete or not to delete any record belonging to a user account terminated by missdiamond.com.tr or the user themselves belongs to Miss Diamond. The user cannot claim any rights or compensation regarding the deleted records.

3.j. The relationships of our site users with each other or with third parties are the responsibility of the individuals.

3.k. missdiamond.com.tr may contain links or references to other websites that are not under its control. Miss Diamond is not responsible for the content of these sites or other links they contain.

3.l. Miss Diamond reserves the right to use all information linked to your user account for its own marketing activities, provided that it complies with the terms of use, privacy principles, and applicable legal regulations.

3.m. Different rules and obligations specific to that section may be specified in certain parts of the site. The individuals and organizations that use these sections are deemed to have accepted these rules in advance.

3.n. To read the measures we take to protect the personal information and privacy of our users and our general policy on this matter, please read the "Privacy Policy" section.

The user agrees that from the moment they start benefiting from the service, they will be deemed to have accepted all the provisions of this participation agreement and that the agreement will be binding on them. The user agrees to indemnify Miss Diamond for any damages that it may suffer due to the user's actions contrary to the obligations specified in this agreement. Miss Diamond has the right to recourse to the User for any compensation and/or administrative/criminal fines that it may have to pay to public institutions and/or third parties due to the user's behavior contrary to the agreement.

4. Miss Diamond’s Rights and Obligations

4.a. Miss Diamond agrees and undertakes that the user will benefit from the services subject to the agreement, except for technical malfunctions, and that no information other than the personal information shared by the user will be shared with third parties or organizations, except for legal obligations. In the event that it is determined that the user has caused any electronic sabotage, attempts to interfere with earnings, and/or attacks that will prevent the operation of the missdiamond.com.tr site, or if a criminal complaint or official investigation request is received from official authorities regarding the member, missdiamond.com.tr has the right to investigate and disclose the identity information of the relevant member.

4.b. Miss Diamond can unilaterally make changes to this agreement without any notification in order to ensure the continuity of the services it has committed to. Miss Diamond always has the right to temporarily or permanently stop the service it provides, change the content of the service, or cancel it without showing any reason. The user accepts this right. In the event of any change, Miss Diamond will publish the updated terms of use on its site with a new date update under the same link, and if it deems necessary, it will notify its users via e-mail. The renewed updated terms of use will be valid from the moment they are published on missdiamond.com.tr, and the use of the missdiamond.com.tr site or its services will be subject to the renewed terms of use from that moment on.

The membership of the member who has sent materials contrary to the provisions of this agreement to the missdiamond.com.tr site may be terminated unilaterally by Miss Diamond without any notification.

4.c. missdiamond.com.tr has the right to use all kinds of information such as e-mail and phone numbers given by users during membership for campaigns, advertisements, and promotional activities.

5. Effectiveness of the Agreement

The user is considered to have committed to complying with the missdiamond.com.tr agreement from the moment they fill out the registration form and approve it, or use this system to receive any service or place an order. The agreement will automatically become null and void with the end of the membership or with the occurrence of any of the termination cases listed in this agreement without any warning.

6. Authorized Court and Resolution of Disputes

The Istanbul Courts and Enforcement Offices are authorized to resolve disputes that may arise from the implementation of this agreement.

7. Notification Addresses

7.a. The missdiamond.com.tr site does not ask for postal addresses from its users in advance. However, the e-mail address that the user notifies to missdiamond.com.tr is accepted as the legal e-mail address where any notification related to this agreement will be requested.

7.b. The parties agree that unless they notify the other party in writing of changes in their current e-mails within 3 (three) days, requests made to the old e-mails will be valid and will be considered to have been made to them.

7.c. Furthermore, any notification that missdiamond.com.tr will make using the user's registered e-mail address will be considered to have been delivered to the user 1 (one) day after the e-mail is sent by missdiamond.com.tr. The user declares, accepts, and undertakes that they have read, understood, and accepted all the articles in this participation agreement and that the information they have provided about themselves is correct.
